인도는 아직도 미개한 나라인가? 아니면 자연식을 좋아해서 남성들이 그렇게 힘이 센건가? 아니면 사회적 염치를 무시하는, Attitude라는 단어가 너무나도 호사스럽게 느껴지는 사회라서 일까?
인도의 수도 Delhi와 북부지방을 약 한달간 여행 하면서 느낀점은 아직도 인도사회의 저변에는 Caste제도가, 인도의 헌법에서는 사라졌지만 불법으로 규정하고 있지만, 그대로 존재하고 있음을 부인하는 인도인들은 없는것 같았다는 점이었다.

신기했던것은, 내가 만나보고 겪었던 인도인들의 대부분은 그러한 사회적 계급에 대해서 불평을 하거나, Advocating을 사회적으로 싸우는 구룹을 본적은 거의 없었던것 같았다.재래시장을 가면, 공중도덕은 거의존재치 않는것 같았으며, 남자들은 시장바닥의 건물에 대고 소변을 줄지어서 해결하는, 그뒤로는 많은 여성들을 포함한 사람들이 움직이고...요즘은 일부 여권 신장운동가들이 활동을 한다는것은 들었지만....
오늘 뉴스에 보면, 수도인 Delhi에서 한 젊은 청년이 86세의 할머니를 유인하여 강간하다 잡혀 철창신세를 졌다는 충격적인 사회고발이었다. 집밖에서 우유배달원을 기다리고 있던 할머니에게 다가와 할머니를 유인하여 외딴 야외로 데려갔었다고 경찰이 설명했다.
젊은 강간범은 할머니에게 다가와 감언이설로 꼬셔서 오토바이에 싣고 빚쟁이에게 같이 가면 할머니가 같이 온것을 보고 동정심을 유발시켜 돈을 쉽게 받을수 있을 것이라고 설득하였다고 한다. 이웃들이 한 여인의 비명소리를 듣고 바로 경찰에 신고하여, 출동한 경찰에 강간범은 체포되여 화를 면했다고 한다.
할머니는 이강간범과 일면식도 없었으며, 경찰은 이강간범이 미리 계획했었던것은 아닌,우발적인 강간범인것으로 보고있다. 할머니는 약간의 찰과상을 입었고 치료후 퇴원했으며, 현재는 안정을 취하고 있다한다. 인도의 법에 따르면 강간범은 종신형을 받게 된다. 되풀이하는 강간범, 집단강간범들 또는 미성년자 강간범은 사형까지 당하게 된다.
지난해에는 33,000건 이상의 강간사건이 보고됐으며, 이숫자는 약 91건의 강간사건이 매일 일어났거나, 매 16분마다 1건씩 일어났다는 계산이다. 2012년 집단갱 강간사건이 있은후, 경찰관이 강간범을 처벌해달라고 고소했는데도 이를 범죄자로 등록하지 않고, 다만 파일만 보관하는 맹점을 악용하여 강간범들이 줄어들지 않는 이유중의 하나라고 한다.
버쓰에서 집단 강간후 살해한 사건이 New Delhi에서 발생하여 전세계를 놀라게한 사건이 일어난후 7년이 지난후 강간범들은 모두 사형집행됐다고 한다.
86세의 할머니가 강간당한 사건을 설명하면서, 이렇게 가장 잔악한 범죄행위는 지난 5년동안에 처음 목격한것이다. 아무리 강력한 법이 있다해도 제대로 법적용이 안되면 무용지물이고, Pandemic으로 사회가 완전 페쇄된 지난 수개월동안에도 강간범 사고가 전연 줄어들지 않았다는 점을 강조한다.
성범죄는 줄어들지 않고, 정부에서 강력하게 법집행을 이행하여, 엄중한 벌을 집행하지 않는한, 성범죄가 줄어들것이라는 기대는 금물이다라고 한탄이다.

The
woman was outside her house in a village in the Indian capital Delhi on
Monday evening when she was allegedly approached by a 32-year-old man
named Sonu, an additional deputy commissioner of Delhi police, R P
Meena, said.
"The
accused asked her to accompany him on his two-wheeler (vehicle) on the
pretext that he had to ask for his money back from someone and that they
would be sympathetic if he was accompanied by an old lady," Meena told
CNN Thursday.
Neighbors heard the
woman screaming for help and called the police. The accused was caught
at the scene and arrested for rape and voluntarily causing hurt, Meena
said.
According
to Meena, the woman did not know the accused and the police don't
believe that the crime was premeditated. The woman sustained minor
injuries during the struggle and has been discharged from the hospital
as she is in a stable condition, he added.
Under
Indian law, rape carries a possible sentence of life imprisonment. The
death sentence is also available for repeat rape offenders, gang
rapists, or people convicted of raping a minor.
The
case has prompted anger from the Delhi Commission For Women (DCW), a
statutory body that investigates safety and security issues relating to
women.
On Wednesday, the DCW wrote a
letter to the lieutenant governor of Delhi -- the constitutional head
of the city -- appealing to him to fast-track the case and ensure that
the accused receives the harshest possible sentence.
The
chief of DCW, Swati Maliwal, alleges that the 86-year-old was assaulted
and raped multiple times, although police have not confirmed those
details.
"The woman's medical
examination report has revealed several injuries and bruises on her body
especially on her private parts," the letter said. "She has bled
profusely and is in extreme trauma."
India has seen several high-profile rape cases in recent years, including the rape and murder of a
23-year-old student on a New Delhi bus in 2012 that made international headlines. Four men were executed earlier this year over her death.
Following
that case, campaigners called for tougher laws on sexual assault in the
country. Despite reforms -- which included fast-track courts to move
rape cases through the justice system swiftly -- the number of reported
rapes has risen since 2012.
Last
year, more than 33,000 cases of alleged rape were reported -- roughly 91
cases each day, or one rape every 16 minutes, according to India's
National Crime Records Bureau.
Maliwal
told CNN Thursday that, after the 2012 gang rape, a law was passed
which said that if a police officer for any reason refuses to register a
rape complaint, then a complaint can be filed against him, which likely
was one of the reasons behind the rise in reported rapes.
However, she believed that the level of brutality in sexual violence crimes had increased in the past few years.
"This
is one of the worst crimes I've come across in the last five years,"
she said, referring to the alleged rape of the 86-year-old.
She
said that stronger laws were not enough if they weren't implemented
properly -- and noted that she had still received numerous reports of
sexual violence from women during the past few months when India has
been in lockdown.
"(Sexual violence
crimes) are definitely not declining and without the government
ensuring timely punishment there is nothing to deter offenders," Maliwal
said.
