Trump, 탄핵에 앞서 선서할것을 민주당이 제안했지만, 한마디로 거절했는데... 규모가 크고 작고같에 민주당이 부정선거를 저질렀다는데서 지금도 분노하고 있는것으로 이해하고 있다. 불난집에 부채질한다는 격으로, 탄핵을 준비하면서, 선서를 하라고 하니.... 상원에서 탄핵을 심의해도 2/3이상의 찬성을 얻어야 하는데, 공화당의 출신 상원의원 5명은 탄핵에 찬성하겠다고 선언했지만, 나머지 45명은 탄핵부결할 것으로 예상되여, 탄핵 통과는 거의 불가능할것으로 예측된다.부통령 Kamala Harris까지 동원되고, 공화당 5명이 민주당에 합류한다해도, 내계산으로는 56명 뿐이어서, 부결될것은 확실하다고 하겠다. 5명중에는 Mit Romney가 포함되여 있다고 한다.
트럼프 보좌관 Jason Miller씨는 "트럼프 대통령은 반헌법적으로 진행시키는 심문에 절대로 응하지 않을 것이다. 이와는 별도로 트럼프 변호사들 역시, 이번 요청은 "국민들에게 보이기위한 스턴트"같은 짖이라면서 민주당의 요구를 일축했다.
상원에서 탄핵 심리는 2월9일에 시작되는데, 기소된 이유는 지난 1월 6일 국회의사당을 불법 점령한 폭도들을 선동했다는 혐의인것이다. 민주당의 주장은 최종적으로 책임을 확인하기위한 자료를 확보하기위해서 필요한 조치라고 설명한다. 한발 더 나아가서, 트럼프가 앞으로는 대통령 재출마를 포함한 공직활동을 못하도록 원천 봉쇄하겠다는 뜻이 포함돼 있다고 이해된다. 지금 민주당은, 4년후에 트럼프가 다시 대통령 선거에 출마하지 않을까?라는 우려 때문인것 같다.
민주당 하원의원으로 이번 탄핵주도하는 인물중의 하나인, Jamie Raskin씨는, "트럼프는 상원에서 탄핵시도중이거나 그전이라도 증거를 제시해 줄것을 요구했었다. 그리고 1월 6일에 있었던 폭동을 지휘했었던것에 대한 쌍방질의를 하고, 오는 월요일 부터 2월 11일 목요일 사이에 이루어져야 한다고 주장하고 있다.
Raskin씨는, 트럼프의 법정대리인으로 이번주 초에, '트럼프는 폭도들을 선동하지 않았을뿐만 아니라, 트럼프는 대통령으로서, 미국인들에게 가장 안전하고 이익이 될수있는 방향으로, 누구나 수긍할수있는, 임무를 항상 이행했었으며,마지막 날까지 수행해 왔었다'라고 주장한 내용을 인용하면서 질의 했었던 것이다.
이논쟁에서 Raskin씨는 설명하기를, 이번 사건에서 설명할 필요도 없이 확실하고, 헌법을 위반한 증거가 차고 넘치는 이사건인데도, 트럼프는 계속 의문을 품어 왔었다고 했다.
트럼프대통령의 변호사 Bruce Castor씨와 David Schoen씨는 몇시간후에 응답하기를, 민주당이 보내 편지내용은, 증거를 하나도 제시하지 못한 상태에서, 탄핵시도를 하는것은 너무도 위험한 게임인것임을 증명한것 뿐이라고 일축한 것이다.
만약에 트럼프가 진술을 거부하면, 하원 탄핵 메니저들은, 탄핵심문과정에서 그의 진술거부내용을 인용하겠다고 설명했는데, 이와 비슷했던 공방전이 지난해 탄핵심문에서 민주당 하원의원들이 제출했던 법정공방내용과 무척 유사한 방법이지만, 그때에 많은 트럼프 보좌관들은 그러한 출두요구서를 묵살 했었다.
"진정으로, 현직 대통령이, 공식적인 임무를 수행하지 않고 벗어난 행동점에 대해 우려를 나타낼수 있다면, 그우려는 이번 사건에서는 확실히 적합하지 않은 상황이다"라고 Raskin씨는 지적했다.
트럼프는 심문을 무시할수 있다. 또한 하원의 탄핵 메니저들은 증인으로 참석해 달라는 출두명령서를 발행할 권리가 없다. 왜냐면 하원은 이미 그를 탄핵하기로 표결했기 때문이다. 상원에서 출두명령서를 발행하거나, 다른 증인들을 출석토록, 간단히 과반수 투표로, 요구할수는 있다.
미국의 민주당도, 한국의 민주당처럼 좌파, 포퓰리즘에만 몰두하면서, 다수당의 횡포를 앞으로 4년간 몰아 부칠것 같다. 미국의 경제는 현재 Covid-19 곤욕을 치르고 있는데, 바이든은 취임 첫번째 행정명령으로 Super Pipeline 건설을 중단시키는 짖을 했다. 캐나다에서는 미국에 무역봉쇄를 해야 한다는 의견까지 나오고 있는 형국이다.
지금은 중국과의 무역및 외교정책이 트럼프 정책에서 크게 벗어나지는 않고 있지만, 오바마 행정부 8년동안, 부통령으로 재직했었던 경험을 되살려, 중국쪽이 요구하는데로 다 돌아가게 될것이다.
그래서 요즘은 완전 좌파성향으로 돌아선, CNN, NY times 등등의 미디아를 거의 시청하지 않는다.
U.S. House Democrats on Thursday asked Donald Trump to testify under oath for his Senate impeachment trial, saying the former president must explain why he and his lawyers have disputed key factual allegations at the centre of the case.
A Trump adviser said Trump won't testify.
The request from House impeachment managers does not require Trump to appear — though the Senate could later subpoena him — but it does warn that any refusal to testify could be used at trial to support arguments for a conviction.
Even if Trump never testifies, the request nonetheless makes clear Democrats' determination to present an aggressive case against him even though he has left the White House, and it challenges him to personally explain the words of his attorneys.
Aim to disqualify Trump from ever running again
Democrats have said a trial is necessary to provide a final measure of accountability. They are also aiming to disqualify him from ever seeking office again.
Democratic Rep. Jamie Raskin, one of the impeachment managers, asked that Trump provide testimony "either before or during the Senate impeachment trial," and under cross examination, about his conduct on Jan. 6, as early as Monday and not later than next Thursday, Feb. 11.
The request from Raskin cites the words of Trump's own attorneys, who in a legal brief earlier this week not only denied that Trump had incited the riot but also asserted that he had "performed admirably in his role as president, at all times doing what he thought was in the best interests of the American people."
With that argument, Raskin said, Trump had questioned critical facts in the case "notwithstanding the clear and overwhelming evidence of your constitutional offence."
"In light of your disputing these factual allegations, I write to invite you to provide testimony under oath, either before or during the Senate impeachment trial, concerning your conduct on January 6, 2021," Raskin wrote.
Trump attorneys Bruce Castor and David Schoen responded hours later that the letter proves that Democrats "cannot prove your allegations" and that an impeachment trial is too serious "to try to play these games."
If Trump refuses to testify, Raskin said the managers will use his refusal against him in the trial — a similar argument put forth by House Democrats in last year's impeachment trial, when many Trump officials ignored subpoenas.
"Indeed, whereas a sitting president might raise concerns about distraction from their official duties, that concern is obviously inapplicable here," Raskin wrote.
Trump can decline the request to testify, and the impeachment managers do not have the authority to subpoena witnesses now since the House has already voted to impeach him. The Senate could vote to subpoena him, or any other witnesses, on a simple majority vote.
